There will be a presentation by Anthony J. Vigliotti, at the Jacob Edwards Library in Southbridge on Thursday evening, May 19, 2011 at 6:30 p.m. The Homestead Act has been changed. You may wish to check your current filing and hear the latest on how you can protect your home.
Chapter 395 of the Acts of 2010, an Act Relative to the Estate of Homestead, revises and replaces the provisions of the Massachusetts homestead protection law, General Laws Chapter 188. An overview of the new Homestead reform legislation, effective on March 16, 2011, will be provided by Registrar of Deeds Anthony J. Vigliotti.
If you filed a homestead declaration prior to March 16, 2011, your $500,000 protection will continue to apply. There is no need to re-file your homestead protections due to these statutory changes. The new law creates an automatic $125,000 protection on homes that do not have a homestead declaration filed at the Registry of Deeds in order to safeguard deposits and situations where a declaration may be incorrectly filed. Homestead protections now extend to pre-existing debts and the proceeds of a sale or insurance coverage.
Mr Vigliotti is the Worcester District Register of Deeds and Assistant Recorder of the Land Court. He is a graduate of Worcester Junior College, A.A. Liberal Arts; Clark University, A.B. Political Science; Suffolk University Law School, Juris Doctorate; and Anna Maria College, Masters Criminal Justice. Prior to his election as Register of Deeds in 1972, Mr. Vigliotti practiced law for the firm of Conte and Conte, and later as a Massachusetts Public Defender. He has served as the president of the Massachusetts Registers of Deeds Association, the Worcester County Bar Association, and Sons of Italy Worcester Lodge #168, and was the former Chairman of the Worcester Democratic City Committee. He serves as the Director of the National Association Clerks, Recorders and Elected Officials; Director of the Justinian Law Society; Democratic State Committeeman, Second Worcester District; State Coordinator of the Property Records Industry Association; State Coordinator for the National Association of County Recorders and Clerks; Co-Chairman of the Land Records Commission for the National Association of County Recorders and Clerks, and Secretary/Treasurer Worcester County Bar Association.
